1Agreement to Terms

By downloading, installing, accessing, or using the VendoSnap application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to abide by the above, please do not use this service.

These Terms apply to all users of the App, including casual browsers, contributors of information, and users who transact business through the App. If you are under the age of 13, you are not permitted to use the App.

2Use License

Permission is granted to temporarily download one copy of the materials (information or software) on VendoSnap for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on the App
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server
• Violate any applicable laws or regulations in your use of the App
• Use the App in any way that infringes upon the rights of others or restricts their use and enjoyment
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks

3User Accounts and Credentials

If you create an account with VendoSnap, you are responsible for:

• Maintaining the confidentiality of your email address and password
• All activities that occur under your account
• Accepting responsibility for all activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You warrant that the information you provide during registration is accurate, complete, and current. You agree to promptly update your information if it changes.

4Acceptable Use Policy

You agree not to use the App for any of the following purposes:

• Uploading, posting, or sharing content that is illegal, obscene, defamatory, threatening, or otherwise harmful
• Harassing, abusing, or threatening other users
• Impersonating any person or entity
• Uploading content that violates intellectual property rights
• Attempting to gain unauthorized access to the App or its systems
• Transmitting viruses, malware, or any code that could damage the App
• Violating any applicable laws or regulations
• Using the App to facilitate illegal activity
• Spamming or sending unsolicited messages
• Scraping or collecting data without authorization

5Content Ownership

5.1 Your Content

You retain all rights to any content you upload to the App, including photos and images. By uploading content to VendoSnap, you:

• Represent that you own or have the right to use the content
• Grant VendoSnap a license to use your content to provide the service
• Warrant that the content does not infringe on any third-party rights

5.2 App Content

All materials in the App, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations, are the property of VendoSnap or its content suppliers and are protected by international copyright laws.

5.3 Limited License

VendoSnap grants you a limited, non-exclusive, non-transferable license to download and install the App on your personal devices for personal, non-commercial use only.

6Image Enhancement and AI Processing

6.1 How Enhancement Works

VendoSnap uses artificial intelligence, specifically Google's Gemini AI, to enhance and transform images based on the styles and parameters you select. The enhancement process includes:

• Uploading your image to our secure servers
• Processing the image through Google's AI models
• Storing the enhanced result in your account
• Deleting temporary files after processing

6.2 Processing Time

Image enhancement may take several minutes depending on image size and current server load. You agree to wait for processing to complete and accept that processing times may vary.

6.3 Quality and Limitations

AI-enhanced images may not always produce perfect results. VendoSnap does not guarantee:

• That enhanced images will meet your specific requirements
• A specific quality level or appearance
• That the service will be error-free
• That processing will always succeed

6.4 No Warranty for Enhancement Results

The enhancement service is provided "AS IS" without warranties of any kind. We do not warranty that:

• The enhanced images will be suitable for your purposes
• The enhancement process will be uninterrupted or error-free
• Any defects will be corrected

7Payment and Subscription

7.1 Paid Services

VendoSnap may offer paid features, subscriptions, or in-app purchases. By making a purchase, you agree to pay the specified amount according to the terms presented at the time of purchase.

7.2 Payment Processing

All payments are processed through Apple App Store (for iOS devices). Your payment information is handled by Apple according to their privacy policy and terms.

7.3 Billing

• Subscriptions renew automatically unless canceled before the renewal date
• You will be charged at the beginning of each billing period
• To cancel, visit your iPhone Settings > [Your Name] > Subscriptions
• Refunds are governed by Apple App Store policies

7.4 Price Changes

We reserve the right to change pricing. Price changes will be communicated in advance, and your continued use of paid services constitutes acceptance of new prices.

8Intellectual Property Rights

VendoSnap and all of its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by VendoSnap, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.

9Limitations of Liability

9.1 Disclaimers

The App and all content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. VendoSnap disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, timeliness, or completeness
• Warranties that the App will be uninterrupted or error-free

9.2 Limitation of Damages

UNDER NO CIRCUMSTANCES SHALL VENDOSNAP BE LIABLE FOR:

• Loss of data or lost images
• Loss of profits or revenue
• Loss of business or anticipated savings
• Any indirect, incidental, special, or consequential damages

9.3 External Links

VendoSnap is not responsible for any external links or third-party websites. Use of external links is at your own risk, and VendoSnap makes no representations about the content or accuracy of external websites.

10Indemnification

You agree to indemnify and hold VendoSnap, its officers, directors, employees, and agents harmless from any claim, demand, loss, or expense (including reasonable attorney's fees) arising from or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your content or information you submit
• Your infringement of any intellectual property or other rights of any person or entity

11Termination

VendoSnap may terminate or suspend your account and access to the App immediately, without prior notice or liability, if you breach any provision of these Terms or engage in any conduct that VendoSnap believes violates these Terms or is harmful to other users, VendoSnap, or third parties.

12Modifications to Terms

VendoSnap may revise these Terms at any time without notice. By continuing to access or use the App after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the App.

13Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

14Dispute Resolution

14.1 Informal Resolution

If you have a dispute with VendoSnap, you agree to first contact us and attempt to resolve the dispute informally. Please contact us at [email protected] with the subject line "Dispute Resolution."

14.2 Binding Arbitration

If you and VendoSnap cannot resolve the dispute informally within 60 days, you and VendoSnap agree that the dispute shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

15Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and VendoSnap and supersede all prior negotiations, representations, or agreements, whether written or oral.

18Apple App Store Terms

You acknowledge that these Terms are concluded between you and VendoSnap only, and not with Apple. You understand that:

• Apple has no obligation to furnish any maintenance or support services for the App
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price
• Apple is not responsible for any other claims, losses, liabilities, damages, costs or expenses
